Welcome to Bordados Custom.

These Terms and Conditions define the rules and regulations for the use of the Bordados Custom website.

Bordados Custom is located at: Rua Marquês de Rio Maior, nº 28, Alhandra, Portugal.

By accessing this website, we assume that you accept these Terms and Conditions in full. Do not continue to use the Bordados Custom website if you do not accept all the terms and conditions described herein.

1. Definitions

The following terminology applies to these Terms and Conditions, the Privacy Policy and the Disclaimer Notice, as well as to any agreement entered into:

Customer, You and Your: refer to the person accessing the website, browsing it or placing an order;

The Company, We, Us and Our: refer to Bordados Custom;

Parties: may refer to both the Customer and Bordados Custom, depending on the context.

All terms refer to the offer, acceptance and consideration of payment necessary for the provision of services or supply of products by Bordados Custom, in accordance with the applicable laws in Portugal.

Any use of the above terminology, or other words in the singular, plural, uppercase/lowercase, or pronouns, shall be understood as interchangeable and referring to the same meaning, where applicable.

2. Purpose and Acceptance

These Terms and Conditions govern:

Access to and use of the Bordados Custom website;

The purchase of available products, including catalogue patches, custom embroidery, custom patches, customised clothing and custom stickers;

The use of interactive website features, such as cookies, contact forms and product customisers.

By browsing the website or placing an order, the Customer declares that they have read, understood and accepted these Terms and Conditions.

3. Cookies

The Bordados Custom website uses cookies.

By using this website, the Customer consents to the use of cookies in accordance with the Bordados Custom Privacy Policy.

Cookies help improve the browsing experience, remember user preferences and make the website easier to use.

Some partners or external services used on the website may also use cookies.

4. Products and Prices

All prices shown include VAT and may be changed without prior notice.

Product availability depends on existing stock.

All products are carefully checked before shipping.

4.1 Colours in Customised Products

For products customised through the customisation tools available on the website, Bordados Custom undertakes to reproduce, as closely as possible, the colours selected by the Customer.

However, the colours displayed on screen may vary depending on the device, brightness, colour settings or monitor used. In addition, there may not be an exact match between the digitally selected colour and the embroidery thread colours available.

If an exact match is not available, the closest possible embroidery thread colour available in our stock or from our suppliers will be used, always seeking to respect the Customer’s intended visual result as much as possible.

4.2 Colours, Images and Product Variations

The images, photographs, simulations, mockups and previews displayed on the website are for illustrative purposes only. The colours viewed by the Customer may vary depending on the device used, screen settings, brightness, contrast, ambient lighting and other technical factors.

For this reason, the final colour of the product received may differ slightly from the colour displayed on the website or in the customisation tool. In the case of embroidered products, there may also be slight variations between the digital colour selected and the actual colour of the embroidery thread available.

Bordados Custom undertakes to reproduce the colours, dimensions, positioning and details of the embroidery or customisation as accurately as possible. However, due to the inherent characteristics of materials, fabrics, threads, embroidery machines and artisanal or semi-artisanal processes, slight variations may occur in the final result.

These reasonable differences shall not be considered a defect or non-conformity of the product, provided that they do not compromise the normal use of the item or substantially alter the ordered design.

4.3 File Quality and Customisation Instructions

The Customer is responsible for ensuring that all files, images, logos, text, names, colours and instructions submitted for customisation are correct, complete and of sufficient quality for production.

Bordados Custom shall not be held responsible for errors resulting from low-resolution files, blurred images, spelling mistakes, incorrect names, incomplete instructions or incorrect choices made by the Customer when placing the order.

Whenever necessary, Bordados Custom may technically adapt the file or design received in order to enable its production as embroidery, a patch, a sticker or another customised product, while seeking to preserve the visual appearance intended by the Customer.

4.4 Brand Labels and Custom Labels

Some products may include a Bordados Custom label, placed discreetly and not visible in the main product presentation, such as on the back of patches, on the collar of garments or in another area suitable for the item.

If the Customer wishes the product to be shipped without the Bordados Custom label, they must expressly indicate this request when placing the order. In the absence of such indication, the Customer accepts that the product may include the brand label.

Upon prior request, the Customer may order custom labels. This service may involve an additional cost, which will be communicated to the Customer before final confirmation of the order.

5. Orders and Payment

An order is considered accepted only after payment confirmation.

Accepted payment methods: MB Way, Credit Card and PayPal.

The Customer will receive a confirmation email with the purchase details.

By placing a custom order and submitting files, images or customisation instructions, the Customer confirms that they have the legal right to use all materials provided and accepts full responsibility for their use.

6. Deliveries

Catalogue patches will be shipped after order confirmation, subject to stock availability.

Custom embroidery, custom patches, customised clothing and custom stickers have an estimated shipping time of 2 to 3 weeks after the order is placed, except in the event of delays caused by suppliers or circumstances beyond our control.

The delivery time stated on the website is approximate and may vary depending on the carrier.

Bordados Custom shall not be held responsible for delays caused by carriers, force majeure events or other circumstances beyond our control.

The rules regarding exchanges, returns and refunds are described in our Returns, Exchanges and Refunds Policy, available on the website, which forms an integral part of these Terms and Conditions.

7. Intellectual Property

Unless otherwise stated, Bordados Custom and/or its licensors own all intellectual property rights to all material displayed on the website.

All rights are reserved. The Customer may view or print pages from www.bordadoscustom.com for personal use, subject to the restrictions below.

The Customer must not:

Republish material from the website;

Sell, rent or sublicense material from the website;

Reproduce, duplicate or copy material from the website;

Redistribute content, unless expressly authorised by Bordados Custom.

7.1 Promotional Images and Visual Content on the Website

Promotional images, photographs, simulations, mockups, product examples, designs, embroidery, patches, stickers and other visual content displayed on the website are the property of Bordados Custom or of the respective customers, where applicable.

The reproduction, copying, downloading, distribution, alteration, publication, commercial use or dissemination of this content in any physical or digital medium is expressly prohibited without the prior written authorisation of Bordados Custom or of the respective rights holder.

Unauthorised use of any image or visual content displayed on the website may result in appropriate legal action.

7.2 Content, Images and Materials Provided by the Customer

Whenever the Customer provides images, logos, photographs, drawings, phrases, trademarks, names, characters, symbols, files or any other material for product customisation, they declare and guarantee that they hold all necessary rights, authorisations, licences or permissions for their use, reproduction and application to the ordered products.

Bordados Custom shall not be held responsible for any infringement of copyright, trademarks, image rights, personality rights, intellectual property, industrial property or any other third-party rights in relation to materials provided by the Customer.

By submitting such materials, the Customer assumes full responsibility for their content and use, and agrees to indemnify and hold Bordados Custom harmless from any claims, requests, costs, expenses, losses, damages, legal or extrajudicial proceedings resulting from the use of the materials provided.

Bordados Custom also reserves the right to refuse the production of any custom order containing materials that it considers illegal, offensive, discriminatory, defamatory, violent, pornographic, in violation of third-party rights or contrary to its commercial values, without prejudice to any other legally applicable rights.

7.3 Photographs and Publication of Completed Work

Bordados Custom may photograph, film and publish images of completed work, including embroidery, patches, stickers and other customised products, for portfolio purposes, commercial promotion, social media, website, advertising and to showcase examples of completed work.

Whenever possible, publication will be made without directly identifying the Customer, except where such identification naturally results from the customised product itself, such as logos, names, trademarks, symbols, coats of arms, text or other elements provided by the Customer.

If the Customer does not wish the commissioned work to be photographed or published, they must communicate this objection in writing when placing the order or before publication.

Bordados Custom undertakes not to publish work containing sensitive data, images of people, data relating to minors, confidential information or elements that may affect the privacy of the Customer or third parties without express authorisation.

8. Disclaimer and Limitation of Liability

To the maximum extent permitted by law, Bordados Custom excludes all representations, warranties and conditions relating to the website and its use, including any implied warranty of satisfactory quality, fitness for purpose or use with reasonable care and skill.

Nothing in this disclaimer shall:

Limit or exclude liability for death or personal injury resulting from negligence;

Limit or exclude liability for fraud or fraudulent misrepresentation;

Limit any liability in a manner that is not permitted by law;

Exclude liabilities that cannot legally be excluded.

The limitations and exclusions set out above apply to all liabilities arising from contract, civil liability, including negligence, or any breach of statutory duty.

To the extent that the website, information and services are provided free of charge, we shall not be liable for any loss or damage of any kind.

9. Changes to the Terms

Bordados Custom reserves the right to change these Terms and Conditions at any time, with such changes applying from the date of their publication on the website.
